Please read these Terms of Use (these “Terms”) carefully as they govern your use of (which includes access to) AskWisy’s personalized training tools for sales script practice, including all of our websites and software applications that incorporate or link to these Terms (collectively, the “AskWisy Service”) and any audio, videos, podcasts, or other material that is made available through the AskWisy Service (the “Content”).
All AskWisy users are held to the conditions on this page during use of the Service. Any violation of this policy, or any time we become aware of behavior, content, or any other factor that may be considered a threat to the System, may result in account suspension, termination, or deletion.
By signing up for, or otherwise using, the AskWisy Service, you agree to these Terms. If you do not agree to these Terms, then you must not use the AskWisy Service or access any Content.
You are responsible for your conduct, content, data, and all communications with others while using the Services. You must use the Services in compliance with, and only as permitted by, applicable law. You acknowledge that you have the full legal right of using all data and content you upload to the AskWisy Services systems, and agree to indemnify AskWisy against any future third party claim and hold AskWisy harmless from those claims.
We expressly disclaim all warranties expressed and implied, including without limitation warranties of merchantability and fitness for a particular purpose. Your use of our services shall be at your own risk. We shall not under any circumstances be responsible for any loss or damages of any kind under any legal theory arising from your use, registration to use, or inability to use, our services, even if we are advised of the possibility of such damages.
All activity by the account is the responsibility of the account owner. All accounts must maintain a valid email address to receive system alerts and other account related messages. Failure to validate account email addresses or maintain a valid and working email address may cause account suspension.
Our service levels other than Free are billed immediately upon subscription, and the service period is set to either monthly or yearly according to the account owner’s choice. The account service is automatically renewed at the end of each service period using the same payment method as the previous period unless canceled by the user. Upon cancellation, the account will be set to not auto-renew when the current paid service expires.
We may make modifications to the service, service levels, and pricing without notice. Your continued use of our service beyond your current renewal or expiration date will be governed by the new service level. All upgrade and downgrade fees are nonrefundable to the extent permitted by law. No refunds or credit will be provided for service less than 1 month. With or without notice to you, AskWisy may suspend or terminate accounts for any accounts for any duration and for any reason including, but not limited to, violation of these or other policies, maintenance, new releases or other improvements, and/or to safeguard the integrity of our connected systems.
All data including file uploads and all settings will be subject to removal from AskWisy for all unpaid accounts.
The AskWisy Service and the Content are the property of AskWisy or AskWisy’s licensors. All AskWisy trademarks, service marks, trade names, logos, domain names are the sole property of AskWisy or its licensors.
AskWisy users may post, upload, or otherwise contribute content to the AskWisy training platform (“User Content”). “User Content” includes all information, materials and other content that is added, created, uploaded, submitted, distributed, or posted to the AskWisy training platform by users.
You are solely responsible for all User Content that you post or upload.
You promise that, with respect to any User Content you post or upload on AskWisy, (1) you own or have the right to post such User Content; (2) such User Content, or its use by AskWisy pursuant to the license granted below, does not: (i) violate these Terms, applicable law, or the intellectual property or other rights of any third party; or (ii) such User Content does not imply any affiliation with or endorsement of you or your User Content by AskWisy or other individual or entity without the prior express written consent from AskWisy or such individual or entity.
You retain ownership of your User Content when you post or upload it to the AskWisy training platform. However, we do need a limited license from you to that User Content for service enhancement. Accordingly, you hereby grant to AskWisy a non-exclusive, transferable, sub-licensable, royalty-free, fully paid, irrevocable, worldwide license to reproduce, make available, perform and display, translate, modify, create derivative works from, distribute, and otherwise use any such User Content through any medium, whether alone or in combination with other Content or materials, in any manner and by any means, method or technology, whether now known or hereafter created, in connection with the AskWisy Service. Where applicable and to the extent permitted under applicable law, you also agree to waive, and not to enforce, any rights of such User Content.
